These Terms & Conditions ("Terms") govern your access to and use of this website, its content, downloadable materials (including brochures and PDFs), forms, and any related services (collectively, the "Services") provided by NATCO Lubricants ("NATCO", "we", "us", or "our"). By accessing or using the Services you agree to be bound by these Terms. If you do not agree, you must discontinue use.
1. Interpretation & Definitions
Headings are for convenience only and do not affect interpretation. Words importing the singular include the plural and vice versa. "Including" means "including without limitation".
2. Eligibility & Acceptance
You represent that you have the legal capacity and authority to enter into these Terms on your own behalf or on behalf of the entity you represent. If you access the Services on behalf of a company, you confirm you have authority to bind that company.
3. Accounts, Forms & Submissions
Some features (e.g., product enquiries, contact forms) may require you to submit information. You agree to provide accurate, current, and complete details and to update them as necessary. You must not impersonate another person or misrepresent your affiliation. Automated or bulk submissions are prohibited. We may refuse or delete any submission at our discretion.
4. Product Information & Technical Data
Product descriptions, performance data, application guidelines, safety or regulatory references, and downloadable brochures are provided for general informational purposes. They do not constitute a guarantee of fitness for a particular purpose. Actual performance can vary based on operating conditions, maintenance practices, and compatibility factors. Always consult appropriate technical support and safety data sheets (SDS) before use.
5. Enquiries, Quotes & Orders
Submitting a form or enquiry does not create a binding contract. Formal quotations, if provided, are valid only for the period stated. Orders are subject to acceptance and availability. We reserve the right to reject or cancel any order prior to shipment/fulfilment and will refund any amount paid (if applicable) as your sole remedy.
6. Pricing & Payment
Prices (if displayed) are subject to change without notice. Taxes, duties, freight, handling, and other charges may be additional unless expressly included. Payment terms will be specified in quotations or invoices. Late payments may accrue interest at the maximum rate permitted by law plus collection costs.
7. Intellectual Property
All content, trademarks, logos, graphics, documents, layouts, component names, and other materials displayed or made available are owned or licensed by NATCO and protected by intellectual property laws. No grant of any license is implied except as necessary for normal, unmodified access to the Services. You must not copy, adapt, reverse engineer, decompile, or create derivative works except as permitted by mandatory law.
8. User Content & Feedback
If you provide feedback, ideas, or suggestions, you grant NATCO a worldwide, perpetual, irrevocable, royalty‑free license to use, reproduce, adapt, publish, distribute, and otherwise exploit such feedback without any obligation to you. Do not submit confidential or proprietary information via public or unsecured channels.
9. Acceptable / Prohibited Use
- No unlawful, infringing, defamatory, or misleading activity.
- No introduction of malware, scraping (except for lawful indexing), or excessive automated requests.
- No attempts to bypass security, rate limits, or access controls.
- No use that could damage, disable, overburden, or impair the Services.
- No misrepresentation of affiliation with NATCO.
10. Third‑Party Links & Integrations
The Services may link to third‑party websites or include embedded content. These are provided for convenience only. We do not endorse or control and assume no responsibility for third‑party materials. Your use of third‑party resources is at your own risk and subject to their terms and policies.
11. Disclaimers
THE SERVICES AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON‑INFRINGEMENT, QUALITY, ACCURACY, AVAILABILITY, OR THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR‑FREE. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES; THESE LIMITATIONS MAY NOT FULLY APPLY TO YOU.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL NATCO, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS; LOSS OF DATA; BUSINESS INTERRUPTION; OR PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES WILL NOT EXCEED THE GREATER OF (A) AMOUNTS PAID (IF ANY) BY YOU TO NATCO IN THE SIX (6) MONTHS PRECEDING THE CLAIM OR (B) USD $100 (OR EQUIVALENT). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; PARTS OF THIS SECTION MAY NOT APPLY TO YOU.
13. Indemnification
You agree to defend, indemnify, and hold harmless NATCO and its officers, employees, agents, and affiliates from and against any claims, liabilities, damages, judgments, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to (a) your breach of these Terms; (b) your misuse of the Services; or (c) your violation of any law or rights of a third party.

15. Suspension & Termination
We may suspend or terminate access (in whole or part) at any time, with or without notice, for conduct we believe violates these Terms or is otherwise harmful. Upon termination, provisions that by their nature should survive (including Intellectual Property, Disclaimers, Limitation of Liability, and Indemnification) will continue in effect.
16. Governing Law & Dispute Resolution
These Terms are governed by the laws of your local jurisdiction (without regard to conflict of law principles). Any dispute not resolved through good‑faith negotiations will be submitted to the competent courts having jurisdiction over NATCO's principal place of business, unless applicable mandatory law provides otherwise.

We may update these Terms from time to time. Material changes will be indicated by updating the "Last updated" date (and/or by reasonable notice where required). Continued use after changes constitutes acceptance.
